Terms & Conditions

1. DEFINITIONS
(a) .In these Terms & Conditions “Housework” describes The Cleaning Works home or office cleaning. “Regular Client” means a client who has booked a minimum of 4 cleans “Booking” means the use of one of our services on one particular occasion. For the purpose of these terms and conditions, the customer shall be referred to as the client(s) and The Cleaning Works as the introductory agency.
(b). the introductory agency shall introduce a cleaner from its database of approved cleaners, to the client on and subject to these terms and conditions.

2. APPLICATIONS
(a) All bookings for The Cleaning Works services are made on these Terms & Conditions only to the exclusion of any other Terms & Conditions, whether written or oral. No alteration to the Terms & Conditions is valid unless contained in a letter signed on behalf of The Cleaning Works by an authorised signatory.

3. CONSUMER PROTECTION (Distance Selling) REGULATIONS 2000
(a) Where a booking constitutes a distance contract pursuant to the Consumer Protection (Distance Selling) Regulations 2000, you will have the right to cancel the contract within 7 days of the formation of the contract, but you will not have the right to cancel the contract where the performance of the Housework has commenced.

4. CLIENT(s) OBLIGATIONS
(a). the cleaner is introduced to the client(s) as a self-employed cleaner and the client(s) shall retain the cleaner only under a contract for services. The client(s) shall agree with the cleaner directly the terms of such contract.
(b). the client(s) shall agree with the cleaner directly what services are to be performed by the cleaner.
(c). the client(s) shall pay fees directly to the cleaner.

5. SERVICE
(a) It is the client(s) responsibility to ensure that property is clear and tidy for staff to commence cleaning works. Moving any heavy objects will not be covered by our insurance and also health & safety legislation dictates an obligation to safeguard our staff’s safety and welfare whilst at work.
All cleaning equipment supplied by the client(s) should be safe and in full working order.
The Cleaning Works cannot accept any responsibility for damages that are made when ironing or laundry service.
The Cleaning Works will not be responsible for triggering any alarm systems. The client(s) should give specific instructions for deactivation/activation of any household alarm systems.
The Cleaning Works reserves the right not to be responsible for: (b) Delay for a cleaning visit due to traffic congestion or broken down equipment
Cleaning job not complete due to the lack of suitable cleaning materials and/or equipment provided by the client(s) not in full working order. Lack of hot water or electricity
(c) For work not completed, or not completed to a good standard if the client(s), other people or trades are working or present at the property when our cleaners are carrying out the job.
(d) Where discolouring of fabric becoming more visible once dirt has been removed.
(e) Existing damage or spillage that cannot be cleaned or removed completely using provided by the client(s) cleaning materials and equipment
(f) Any damages or accidental damage costs caused by faulty equipment and cleaning materials provided by the client(s).
(g) Any accidental damages caused by our cleaners if the client(s) has an outstanding balance owed to The Cleaning Works.

6. PAYMENTS
Standing Orders and Terminations.
(a) The client(s) shall arrange a standing order mandate authorising payment to be made by the bank of the client(s) monthly in advance, these payments will continue until the agency agreement is ended as outlined below:
(b) All client(s) are responsible for cancelling the standing order on ending the agreement. On failure to do so we will impose an administration charge of £25.00 to reimburse any payments.
(c) Standing order payments are a retainer fee and cover your annual insurance. As a result, we regret we are not able to refund them except in exceptional circumstances.
(d) Please give 1 month notice in writing to The Cleaning Works office to end this agreement.
(e) The Cleaning Works have the right to terminate the agency agreement by giving notice to the client(s) in writing.

7. INSURANCE AND LIABILITY
(a) The Cleaning Works provide public and employee liability insurance cover up to £1 million.
(b) We will not accept any responsibility of claims less than £250.00 in value. Where the claim is more than £250.00 our client(s) will be responsible to pay the initial excess of any such claim.
The policy will cover any accidental damages (worth over £250.00) caused by cleaner while working on behalf of The Cleaning Works, if reported within 24 hours after the service has been performed The client(s) shall have valid adequate insurance cover against liabilities to the cleaner and shall produce to The Cleaning Works a copy of the appropriate insurance policy and certificate if requested. The Cleaning Works shall not be liable for any consequential or indirect losses incurred by client(s) as a result of any failure of a cleaner to comply with his or her contractual obligations, theft or collusion for whatever reason.
A good and thorough cleaner will break a glass every few years simply because they are human. If a glass or mug is never broken, it means they are never cleaning anything.
The Cleaning Works will not be liable for any liability caused by or arising out of or from:-
(c) Damage to windows, articles of glass, china porcelain, earthenware, stone or other articles of a brittle nature.
(d) All fragile and highly breakable items must be secured or removed. Items excluded from liability are: cash, jewellery, items of sentimental value, art and antiques.
(e) The Cleaning Works shall not be liable for collusion or theft of property or possessions.
(f) We take no responsibility for the use of bleach or bleach based products used, our insurance does not cover the use of these products. (g) Commercial and Public Buildings must have Building Insurance liability cover in place, which must be produced on request.
(h) If you change days, times of the cleaners days/times, please simply inform the agency in advance where possible, or within 2 working days of the clean, as the insurance cover requires that we are aware of the times and days your cleaner is working in your home.
(i) The Cleaning Works full and detailed liability insurances are available on request.
(j) Force majeure & jurisdiction – Neither party shall be liable for any failure in the performance of any of its obligations under this agreement caused by factors outside its control. English Law shall cover this agreement and the parties consent to the exclusive jurisdiction of the English courts in all matters regarding it.

8. USE OF CLIENT INFORMATION
Any information you give will be held and used by The Cleaning Works to perform the business for which we are registered. This may include sending you details (including but not limited to email, SMS, post) of The Cleaning Works offers and services that we feel may be of interest to you. The Cleaning Works WILL NOT pass on any of your details to any other company or 3rd parties unless we have your permission.

9. GENERAL
The Cleaning Works reserves the right to amend these terms and conditions if necessary. An up to date copy is always posted on the The Cleaning Works website.

10. Non-Solicitation
The Client is liable for an employment referral fee of 12 months agency fee, should they directly employ anyone currently contracted by the Company. The Client agrees to pay this fee whether they notify the Company of their action or the Company discovers this employment independently at any time after it occurs. The Client further agrees to reimburse the Company for any and all collection or legal fees the Company incurs in collecting this fee.
